Furthermore, ABQGuides.com™ may use its own discretion in determining the appropriate course of action. If ABQGuides.com™ determines that illegal activities may exist, then it reserves the right to suspend or terminate the business relationship status. The hourly rates are compensation for the Guides time only. The rates do not include meals, show tickets, out-of-town transportation or any related expense, etc. You understand that the services are not an offer for prostitution. Money exchanged is for time and companionship only. By paying by credit card, you agree to be the one and rightful owner of the billing information. Tips
Tipping is purely discretionary and NOT expected. If you have an exceptional experience and wish to tip our Guides, they will be honored. Cancellations
Should you not be entirely satisfied with the Guide of your choice, within the first 15 minutes of your meeting, please inform us. A cancellation fee of $25.00 will be deducted from the refunded amount paid. You can also leave your remaining balance as a credit for a future session and we'll waive the $25 cancellation fee. Age
You represent and warrant that you are of legal age, depending on the legal age law in your city or state, and that you have the legal capacity to enter into this agreement. If you are not of legal age, depending on the age law in your city or state, you must exit the Site immediately and may not use or access the services of this site. Independent Contractor
Guides are independent contractors and not employees of ABQGuides.com™. The position of our Guides shall not be construed as a relationship of employee-employer, partnership or joint venture between any participant, sponsor and ABQGuides.com™. It is impermissible to assert or imply that a Guide will be employed by ABQGuides.com™. Illegal Activity
Respective officers, agents, employees, affiliates, subsidiaries, partners, and representatives of ABQGuides.com™ do not allow, condone or tolerate illegal activity of any kind. Any activity at anytime affiliated with the use of this service that is a violation of any state or federal law is a violation of these Terms and will result in immediate termination of business relationship. Prohibited activities include, but not limited to: prostitution, drug trafficking or the solicitation of any sexual favors for profit. Using this site and the services offered indicates that client has not ever, in any city, state or country been arrested, convicted or affiliated with any similar illegal activity related, but not limited to: prostitution, drug trafficking or the solicitation of any sexual favors for profit. Should we merely suspect that there is any sign or form of Illegal Activity, we reserve the right to notify the authorities and seek damages that could incur on our company. Miscellaneous
ABQGuides.com™ is not responsible for clients or Guides health, wellness contracted through moral or illegal actions including, but not limited to: infections, welfare, contagious illnesses, pregnancies, directly or indirectly related to the duties performed in accordance of this contract. Any attempt to persuade, remove, conduct business with our Guides without the knowledge or authorization of ABQGuides.com™ is a breach of these Terms and will face penalties and damage recovery designated by ABQGuides.com™ including, but not limited to: Guide & Client estimated profit losses, legal fees and expenses incurred due to breach. Penalties for on-the-side service fulfillment is the monthly average amount spent by client at a five year pay out. Termination
ABQGuides.com™ may terminate business at any time without written notice to client. In addition, if client is convicted of any crime or offense, fails or refuses to comply with the written Terms or reasonable directive of ABQGuides.com™, is guilty of serious misconduct in connection with performance hereunder, or materially breaches provisions of these Terms, ABQGuides.com™ at any time may terminate the engagement of the client immediately and without prior written notice to client. If client physically abuses, verbally abuses, or grossly disrespects a Guide in a harassing manner, the session is immediately terminated and all paid fees are forfeited. Client will no longer be able to do business with ABQGuides.com™ or our Guides in the future.
Limitation of Liability
To the extent allowed by applicable law, IN NO EVENT SHALL ABQGUIDES.COM™, ITS OWNERS, PARTNERS, GUIDES, AFFILIATES OR REPRESENTATIVES, BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION, ANY LOSS OF PROFITS, LOSS OF BUSINESS, PERSONAL LOSSES, HEALTH & WELLNESS, DEFAMATION OF CHARACTER, FINANCIAL STABILITY, FUTURE OR FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY, THIS LIMITATION OF LIABILITY IS AN ESSENTIAL PART OF THE BARGAIN UNDER THIS AGREEMENT. To the fullest extent permitted by law, visitors and clients of ABQGuides.com™ shall defend, indemnify and hold harmless ABQGuides.com™, Owner, and any of their respective directors, officers, agents, employees, affiliates, subsidiaries, partners, and representatives, and any other persons or entities designated by any of them from and against all actions, demands, liabilities, claims, damages, costs, losses, and expenses, including but not limited to attorney fees and costs, which arise out of or are in any way related to these Terms or the projects to which it relates (all collectively referred to as "Liabilities") and which also involve death, bodily injury, property damage, or loss of use of tangible property.
